The Effective Deposition: Techniques and Strategies That Work (Nita Practical Guide Series)

Book Description
The mechanics of taking and defending depositions are simple, but to avoid mistakes you must be thoroughly familiar with the applicable rules. Small or inadvertent mistakes can cost money and time, and prevent the use of valuable deposition testimony on behalf of your client. In this popular book, David M. Malone and Peter T. Hoffman help you master the critical deposition skills you need to compete in the courtroom. The Effective Deposition, Revised Second Edition, incorporates the 2000 Amendments to the Federal Rules of Civil Procedure. These amendments focus on, among other things, the scope of discovery, the length of depositions, and what is required by the mandatory disclosures. This book discusses how to take and defend depositions under the Federal Rules as they existed through the year 2000 and note any changes due to the 2000 Amendments. Since many states still follow the pre-1993 version of the Federal Rules concerning discovery, the practice under the pre-1993 version is examined as well.

Court cases are never as quick and tidy as television dramas would have us believe. In fact, most civil disputes are settled long before a judge has a chance to pound a gavel. That's why pretrial fact-finding procedures such as depositions play an increasingly important role in legal quarrels. In fact, it's not uncommon for a deposition to be the only testimony given. All of this explains why Nolo's Deposition Handbook can be such a useful resource. For the uninitiated, depositions are the process that enable either party in a lawsuit to question the other, as well as other witnesses, under oath before a trial begins. To prepare readers, authors (and attorneys) Paul Bergman and Albert Moore do a commendable job of dealing with real-life issues, such as what to do--and not to do--in preparation for a deposition, what to do if you're asked to bring documents to a deposition, how far you can be required to travel, and how to deal with trick questions that many lawyers love to ask. Three "Golden Rules" are also offered to help people through the deposition process. Put simply, the rules are to listen to the entire question and then answer only that question; answer truthfully and completely; and if you don't understand a question, don't answer it. The tone of the entire book acknowledges--without being condescending--that legal arenas are an area where novices feel quite underqualified. For example, the authors warn against engaging in seemingly harmless chit-chat with a companion before and during breaks in a deposition. The reason is one that most non-lawyers would be hard-pressed to imagine: Deposing counsel can ask the companion to reveal what the deponent said. Of course, readers intrigued by that line of thinking will thoroughly enjoy the last half of the book, which is devoted to those interested in representing themselves in legal matters. --John RussellBook Description

Argument Slides: Quick Mastery of Exhibits for Cross and Closing (Easytech Series)
Deanne C. Siemer , and Frank D. Rothschild Manufacturer: National Institute for Trial Advocacy ProductGroup: Book Binding: Spiral-bound Similar Items:
ASIN: 1556818459 |
Book Description
Argument Slides, the second volume in NITA's EasyTech series, demonstrates how to create electronic displays for cross-examination and closing argument using PowerPoint® 2002. In most trials, the final presentation to the jury will be more effective with the addition of visual support. Likewise, cross-examination can also be enhanced by argument slides in certain cases. The argument slides discussed in this book have wide applicability for all kinds of civil and criminal cases. They have proven jury appeal, providing good learning platforms for facts that are unfamiliar to jurors. These designs also give you a head start in thinking about ways to present arguments, and a good point of departure for designing slides specially tailored to the needs of a particular case.
Deanne C. Siemer and Frank D. Rothschild examine two basic types of argument slides: designs that are essentially argument, such as weight of the evidence slides, relationship charts, yes-no checklists, decision tree charts, and relative merit charts; and ordinary slides used for opening statements and direct examination, such as bullet point lists, photos, documents, and diagrams and charts, that become argument slides if decorated with argumentative words, animation, color, cropping, or other presentation techniques that sell a point of view.
For those who need a reminder about basic PowerPoint operations, the Quick Reference chapter at the end of the book summarizes basic PowerPoint 2002 terms and techniques.
