Entertainment Law
Book Description
Are You Ready To Advance Your Music Career? Then Put It In Writing!
Forget hiring an entertainment lawyer, use this set of industry standard, professional contracts and save big time. Sure our set may cost a little more then the others, BUT you get what you pay for QUALITY!
This set of contracts comes in two easy to use and understand formats, in a preprinted binder and on CD-ROM (pc/mac compatible) - You receive both the binder and CD in this set, with both containing all 101 contracts. We supply you with the contracts in both a pre-printed binder, and on CD.
The binder set comes preprinted, which allows you to take each contract out and use it as is, or make copies of it if you need to.
The CD contracts program, which can be installed on all computers, including PCs and Macs allows you to open up the contracts on your computer in any text editor such as Microsoft Word, Note Pad, Word pad, or any other text editor, which comes installed on all computers. The great thing about installing the CD contracts program onto your computer is that it also allows you to edit any of the contracts, meaning that you can delete specifics that may not apply to your particular situation. With the contracts software program, you can even add things to each contract if needed and then print whichever contract(s) you need directly from your computer, whether it be one or fifty copies. The things that you can do with this program is unlimited, plus remember at this economical price you will receive all 101 of the contracts in both a preprinted binder and on CD-ROM that you can use to edit and print as many contracts as you need..
For a list of all one hundred and one contracts that are included see below
Think about it, even if you use just one of the contracts that are included in this set, you would still be saving money versus if you hired an entertainment lawyer to draw up that same contract at $200.00 per hour, at say 2-3 hours worth of his time! Plus every single contract included in this set has been drawn up by a very knowledgeable, entertainment attorney and is guaranteed to hold up in court in all 50 states if ever needed.
With our set you pay a small price for over 100 different contracts, an entertainment lawyer would charge you hundreds just to draw up a few contracts.
If you're like most musicians, you have a background in creating music, but not in the business side of it. If that's the case, ordering this set of 101 Music Business Contracts is your first step to a secure entertainment career.
Our set of contracts has something for everyone in the music industry from musicians to singers to writers to label owners to producers, here is a list of all of the contracts that you will receive; Agreement of Distribution<BR> Agreement of Foreign Agency<BR> Agreement to Pay<BR> Agva Performance Contract<BR> Artist Management Agreement 2<BR> Artist Producer Agreement<BR> Artist Producer Contract<BR> Artist Record Contract<BR> Artist Tech Rider<BR> Assign of Copyrights<BR> Assign of Copyrights 2<BR> Assign of Copyrights 3<BR> Assign of Copyrights 4<BR> Booking Agreement 1<BR> Booking Agreement 2<BR> Broad Rights License<BR> Broadcast Agreement<BR> Broadcast Release<BR> Cooperative Promo Agreement<BR> Commercial Music Agreement<BR> Composer Agreement<BR> Composer Agreement 2<BR> Concert Performance Agreement<BR> Co-publishing Agreement<BR> Short Form Copyright Assign<BR> Copyright License 1<BR> Copyright License 2<BR> Employment Contract<BR> Event Sponsorship Agreement 1<BR> Event Sponsorship Agreement 2<BR> Exclusive Songwriters Contract<BR> Exc. PROTECTING OUR INTELLECTUAL/PERFORMING RIGHTS.......2006-11-02
I HAVE USED "101 MUSIC BUSINESS CONTRACTS" TO SIGN MY DAUGHTER AMANDA SHELBY TO AN ALBUM PRODUCTION DEAL WITH A VERY SUCCESSFUL PRODUCTION TEAM IN SWEDEN, A BOOKING DEAL HERE IN THE SAN FRANCISCO BAY AREA AND A MANAGEMENT DEAL IN LOS ANGELES. I'VE SAVED THE COST OF THE BOOK IN LEGAL FEES ONE HUNDRED TIMES OVER. NO ONE CHALLENGED THE CONTRACTS IN ANY WAY.
MOREOVER, IT'S MUCH FASTER TO PUT A DEAL TOGETHER WHEN YOU DON'T HAVE TO WAIT FOR AN ATTORNEY TO SCHEDULE YOU IN.
Best contract software around!.......2006-07-21
I just bought the download version of this software and as a professional musician and artist manager I say it is a must have item.
Thanks,
JL
great.......2006-07-14
Wow, this is the thing that I have been waiting for the "101" book sequel that would come on a CDROM. I thank the authors for this it made my work a lot more easier and the updates are spot on
amazing.......2006-07-14
Wow, as much i can say i liked the paperback version this one just blew me way. The updates really make the book worth more that you'd predict and the availability of the CDROM format means that you can take it everywhere with you without worrying that pages might get torn
great as usual.......2006-07-14
Great work as usual this transition from paperback to CDROM worked best for me, I do like the book but i could not take it everywhere with me so a CD with all the contracts i need is one of the best choices i could have. Content is all the same but now in a digital format, easier to search through and a fresh contract at the touch of the print button

Practical divorce advice.......2007-04-17
Interesting book coming from both the perspective of the divorce lawyer and a psychologist. Some good, solid advice here. While going through a divorce you should gather as much information as possible and know how to protect yourself both emotionally and financially.
Seven Secrets to a Successful Divorce
Important book, along with..........2006-01-04
Divorce is one of the most grueling experiences anyone can go through, and this book is a great guide for easing the challenges. The book is packed with information on the legal and emotional issues that are likely to arise -- and how to deal with them. The topics span the board, from making the initial decision, to preparing for trial, to how to talk with the kids about it all.
THe authors have a section on negotiating with your spouse, and I think that that is essential. They mention the work of Harvard's Roger Fisher, who just published a new book that you don't want to miss if you're dealing with divorce. The book is 'Beyond Reason: Using Emotions as you Negotiate.' (The chapters on autonomy and appreciation struck a chord with me and offered great advice.)
Very Informative, but deceptively biased.......2005-07-03
After reading many, many studies on the subject of divorce, support and custody, and also personally being a single father for 13 years with sole custody of 3 children and also being a non-custodial parent of one younger child I feel I can comment objectively on this book.
First off, it is clearly very well written, covers almost all aspects of its subject and uniquely combines views from an emotional point of view as well as legal point of view. It also strives to be unbiased and provide clear representation of both parents. I do recommend this book but do so with one caveat (hence my rating of 3 stars rather than 5).
The book is riddled with hidden biases in favor of Mom rather than Dad and the reader should be cognizant of that. Also, it is not clear that all aspects of studies are clearly represented. i.e., both sides. The tricky thing is that both sides are mentioned but even when there is a preponderance of studies favoring one side, it seems the authors may lean towards the other side. A fairer presentation of studies supporting both sides would be really beneficial (particularly on child custody, visitation, overnights, bonding, etc.). Many of the studies are represented in summary form and as such remove a lot of important context.
A good example of a hidden bias:
"The Paradox requires that parents take into careful consideration how well their children are able to tolerate separation from their mother, the child's temperament, and the strength of the father-child bond prior to divorce, and weigh all this against the likelihood of the father staying in the child's life...." Page 203 - determining custody arrangements.
This seems like a very objective statement but upon closer examination it is clear that the authors are concerned with whether the child(ren) can tolerate separation from mom but never question whether or not the child(ren) can handle the separation from dad or what that impact might be. In addition, it questions the father-child bond but never suggestions that the mother-child bond should be evaluated as well in such a determination. The phrase ends with us weighing all of this against whether or not it is likely that dad will stay in the picture - again, what about mom. Studies are increasingly showing that even when mom has full custody of her children she can be less than a model parent for a variety of reasons.
Here's another:
"The amount of time between father and child is important because it facilitates a closer parent child relationship. But time does not automatically equal closeness. The quality of time spent and the level of involvement .... are ... more important." Also Page 203 - determining custody arrangements.
Again - sounds objective enough but actually why is this represented only in terms of dad. Isn't this statement true for moms as well? Phrased as written there is an assumption that mother time does equal closeness and that it is automatically quality otherwise why point this out only for fathers during a discussion on custody which should be gender neutral. If the term was written with parent in place of father then it would be truly objective. As written it supports the notion that moms are custodial parents and dads are visitors - and not to worry about the amount of time dads spend - but worry about the quality of time they spend. So to be fair, don't worry about the time mom spends with the children, just the quality of time she spends - thereby freeing up large amounts of time for dad and children.
These are only 2 examples but please read this book with caution, such biases are sprinkled all through out the book (perhaps because the authors are both moms) and amongst a backdrop of authority, general objectivity and mastery of the subject matter which makes them all the more dangerous.
Extensive Information.......2005-04-23
This book is filled with extensive information. With over 60% of the population getting divorced, this subject should no longer be taboo.
Barbara Donahue, Author of "The Anti-Rules, Now That
You've Got Him, How Do You Get Rid Of Him"
The DEFINITIVE Divorce Guidebook.......2005-04-04
"Your Marriage Advisor: A Lawyer and Psychologist Guide You Through the Emotional Landscape of Divorce" by Diane Mercer and Marsha Klein Pruitt is arguably the most respectable and comprehensive guidebook on Divorce out there in the market place. The co-authored divorce guide, written by a divorce mediator and a research scientist in child study, takes you on an informative and rational ride through the entire divorce process, both the legal and psychological aspects of it. Imbued with positive energy, the authors breathed a much needed breeze of fresh air in an area where bickering and revenge is rife, highlighting that "the best strategy is to take care of yourself and your family, especially your children...this is truly your mantra".
Complete with case studies and extensive discussion from the A-Z of all that you need to know on the divorce procedure/psyche, the book is well-balanced where the authors weighed the pros and cons of oft-repeated tactics, not least stressing ad nauseam that retaliation and lying to get your way as non-viable options. It is one of those rare self-help books where the humanity and sterling character of the authors shined through as readers are constantly reminded how divorce is a no-win scenario to all and how one should best move on from the unpalatable situation in one piece. This book is a gem amidst the universe of divorce guides advocating revenge, male/female bashing and dirty tricks. Equipped with knowledge from this book, readers could save their sanity and their children's, not least money on oftentimes deficient advice from attorneys who have their own agendas to meet. This book is good place to start when confronted by the "D" word and is placed right on top of the priority must-read list if you have just time for one.

Although I did not see "Celebrations" myself because it was sent out as a gift, the recipient was very pleased. She described it as very user friendly; easy to find what you want quickly. She said the book had some new and interesting ideas that she was already putting to use. She went on to say that it was one the best of this kind she had seen in a while (and she sees quite a few).

Customer Reviews:
MUST Have.......2007-05-12
If you wanna get into any sort of video field, or wanna know how the industry functions, and what are the legal and business issues you have to deal with...
...this book is a MUST Have.
Good book for everyone that wants to know the business.......2007-01-19
not only did I get this for myself but I got two other friends their own personal copies (got tired of them borrowing mine). It will keep you out of legal trouble in the film industry and give you insight as to how things are structured.
More Than a Great Book--It's a Public Service.......2004-06-16
This is more than a great book--it's a public service. The
authors share insights from their decades of legal and
entertainment production experience, in essence offering
thousands of dollars of free legal advice to aspiring
independent producers. Beyond offering a roadmap of business-
planning steps, the book includes templates of numerous legal
forms that an independent producer might need. Meanwhile, in
clear and artful prose, they alternate between You're-Not-God
straight talk and You-Can-Do-It encouragement. Between the
lines, there seems to be a genuine interest in helping
important stories and quality independent work to see the
light of day. I've read other books on the business side of
entertainment that were helpful, but this stands out as the
best of the lot.
The bible of independent film producer.......2003-08-27
If you are or want to become an independent film producer, this book will give you all of the business/legal knowledge of filmmaking you need. Even though I have not finished the book yet, I've already found this book to be extremely valuable. Because I am planning to produce a new film next year, I even called up Mr. Tulchin directly for legal advice. He was very friendly and took the time to give me great advices and was very knowledgeable in not just U.S. based entertainment law but also international entertainment law as well. Read this book and you will find it worth more than what you paid for!!!
The 'business' of 'show business' explained.......2003-04-19
One thing that isn't taught that much at film schools is how many contracts are generated and how much time you spend negotiating deals. Our first film is still in post-production (April 2003) and we already have a filing cabinet filled with contracts and paperwork. I wish this book had been available when we started production. The chapter on delivery requirements alone is worth every penny. In it you'll find out what a distributor will want along with your film. Don't forget the still photographer on the set and behind the scenes! Great and easy read, too.

A helpful examination of the entertainment business.......1999-05-05
As an attorney teaching an entertainment law course to undergraduates at the University of Notre Dame, I've found this text book to be very useful. Not only does it address and examine legal issues that face entertainment industry persons, it examines *how* the entertainment industries actually work. The vast majority of my students have found this book to be useful and worthwhile.

Customer Reviews:
An excellent resource.......2005-10-08
This book (textbook) is an excellent resource for just about everything in TV. The disk included is a great utility to have for printing out your own contracts. I only with this book could be updated, say, every two years.
Stolen 3 times... This book is hot!!!.......2002-04-04
This book is so hot that it's been stolen from my office library 3 times. I'm on my 4th purchase of this book. I felt like I could have an intellegent conversation about any aspect of the television business after using this book. It is my main resource for getting quick answers that are easy to understand. This is required reading for those getting started and a great resource for those that have been in the industry a while. It also includes a computer disk containing forms such as U.S. Copyright registration and others found in the book that you can import to your word processor.

Imagine the Future, Study the Past.......2000-11-08
This Business of Television is a landmark volume in our practice (micro-economic forecasting for the entertainment industry). Here are the top three reasons why.
Reason # 3: it is incredible that guys of this stature would take the time to compile such an essential and complete perspective of the television business. Goodenough, a seasoned entertainment lawyer, law professor, and a scholar pioneering the study of law and evolutionary biology, brings the structure and rigor, while Blumenthal, a prolific TV, multimedia, and online entertainment producer and businessman brings the been-there-done-that street savvy.
Reason # 2: it is, after all, the business that pays for the content (the subscriber, pay-per-view, advertising, syndication, and the latest, e-commerce revenue models) and the content that drives the migration to new technology (streaming media webcasting and video-on-demand, interactive TV, and wireless). The clear understanding of the financial systems supporting television and video entertainment offered by Oliver and Howard in this book facilitates the modeling of future monetary transactions.
Reason # 1: video programming spread from broadcast to cable and then to satellite in one generation. The last decade found it spreading to the PC via CD-ROM, DVD, and broadband Internet. In the future it will be found on our cell phones, wristwatches, car seat backs, and refrigerators. There will be innovations in business arrangements along the way, but those who cannot converse in the language of economics will be doomed.
<segue> The second edition proudly bears a jacket quote by Morty Morton, former producer of the Late Show with David Letterman, who remarked, "This Business of Television has gotten me through years of moderate success in the TV business. I'm now ready to burn the damn thing and open a restaurant."

Customer Reviews:
Best book Ever.......2007-05-02
Superb book. Enormously Practical text. The best intellectual property law and game development book on the market. A very healthy read. may change your whole perspective on business, games and life.
AMAZING.......2007-04-30
This is one amazing book. It quite literally addresses every possible business and legal issue for the game industry. Not only that, the information in this book is applicable to really any software or software intensive company. A+
Great Background Information.......2007-01-19
If you are even thinking of forming a company in the computer gaming industry, or if you're an outside developer presenting a game to a company, here is a wealth of information. Of course, as one of the contributor says, 'if you have $10 million already and you are starting a game company, then you can afford to hire a lawyer to do all this work for you.' But just to double check the work he is doing you still should read this book.
This book really has two sections. First is about starting a company. This is on all the general business parts like creating a legal business entity, renting an office, hiring staff, product and market analysis, raising capital, etc.
But then comes the second part that is specific to the gaming industry, especially the intellectual property that you are creating as you define characters, the art aspects of how the game looks, and the contracts you will need to have in place with your developers or with a game distribution company if you use them.
There's another aspect that could fit under either of these two as they are not standard for most businesses but not restricted to games either, this includes selling internationally, paying international taxes and so on.
Basically, as the title of this book says, it's a 'Primer,' that is, a general introduction that will enable you to know what you're talking about but not enough to consider yourself an attorney.
Amazing resource..........2006-12-11
I am an attorney who only occasionally encounters intellectual property issues stemming from "gaming" in my practice. However, like most males my age, I'm fascinated by the video game industry, and in particular, video game development. I picked up this book to learn a little bit more about gaming issues--partly in the hopes of expanding my practice, partly in an effort to learn more about the industry--and ended up buying this primer on a whim. It turned out to be a great decision...not only does this book provide the astute, rock-solid legal analysis I would expect from a legal primer, it also gives an amazing and exciting inside look at the world of development.
The primer begins with a good-natured and insightful perspective on starting your own game company, winds its way through the trials of day-to-day business operations and ends up with some shared experiences from those who have "made it" in the world of video game development, including the co-founders of GameLab. In between, well-researched and easy-to-understand legal advice is dispensed on a wide range of pertinent topics, including intellecual property law, contract law, taxation and even the current state of law in virtual worlds.
In short, this primer is an affirmatively *enjoyable* read--a rarity among legal primers, as I can unfortunately attest--and a must-read for would-be developers and anyone else who wants to really understand the ins and outs of video game development. I plan on recommending it not only to my clients but to anyone who is even remotely interested in learning more about the gaming industry.

Book Description
To help artists avoid hidden agendas, this book exposes the multi-layered language of recording agreements crafted by major label lawyers. Clause by clause, it deconstructs actual contracts and translates them into "real English," presenting the original and decoded versions side by side. Focusing on artistsÕ issues, such as advances, royalties and distribution, this revealing handbook explains the need for each clause, offers advice on negotiating fine points, and outlines alternatives for developing new contracts. User-friendly, it clarifies common terms uniquely redefined by the music industry, and has entertaining inside stories.
"Considerable wit and wisdom on this festering snake pit of a business."

Customer Reviews:
A classic!!!!!!!!!.......2006-07-03
As soon as I bought the book I could not put it down I read it from top to bottom non-stop. This book is an easy read and very applicable. I highly recommend this book to gain greater insights in the Music business or any business. It was a great buy along with a couple of manuals purchased from Musicbrains.net entitled the Indie label Kit on Amazon, Music business 101, future of music and Guide to releasing an independent record by Tim Sweeney.
excelent.......2006-05-15
The music industry world ins an alien environment for most of the emerging artists and many need guidance to avoid scams and legal glitches, this book can be a good guide in defeating those lawyers that try to fool you into a deal. Despite the depth and professionalism , the book it isn't the best out there,” Music Business & Entertainment Law Contracts for Indie Recording Artist, Labels, Songwriters, Composers, Producers, Managers and All Others in the Record Industry. Binder / CD-ROM set (PC & Mac)" by Ty Cohen is far better when dealing with all the aspects and it includes viewpoints from different men in the industry, and also includes clear and easy to understand examples
Real World Advice from a Real Guy - Highly Recommended.......2003-09-21
Not only is this book (and it's prequel, "Confessions of a Record Producer") the real deal, so is the man who wrote it. I was so impressed by his first book that I contacted him as a consultant on a producer/artist agreement I was negotiating (I am a producer). My goal was to come up with something that was actually fair to both parties and Moses got us to that point quickly. His suggestions were works of innovation that surprised and satisfied everyone.
I also attended his 2-day seminar which dissects recording contracts. Here he dispelled the many misconceptions I had about record companies and their contracts AND he helped me to understand what is really being said in these contracts (and it's scary!).
He is not a lawyer, but one of the most insightful men I've met. Lawyers pay HIM for his advice. He REALLY understands contracts and explain things in a manner no one else seems to be able to do - it must be a sixth sense.. Highly recommended reading. Both his books should be permanent reference books for anyone in the music business. Besides, they're fun reads, unlike most other "how-to" music-biz books.
Staright to the point, easy to understand and insightful.......2002-09-03
This book is easy to read. It goes straight to the point and gives you inside information so you can undestand everything. I recommend this book to any kind of person, including lawyers (like myself).
Absolutely perfect........2002-05-26
Avalon fills the books with plain text translations of virtually every major clause in a standard record deal and makes it very easy to understand. He puts in plenty of narration and real world examples to let you see how each of these clauses can come into play and where loopholes lie so you won't just have to take your lawyer's word for really anything. Great book. Will save you tonnes of cash in legal fees and might end up saving your career. My only complaint is that he uses false names for all the stars he talks about in his examples to protect himself from being sued. But a lot of them are really famous so if you think about it you can figure a few out (I found the Michael Jackson one quite an eye opener). Definitely recommend it.

Customer Reviews:
Good Advice for All.......2003-07-08
I've been running a video game company that is now over 10 years old. It is refreshing to read a book that distills the important information, approaches the industry with a clear mind, and promotes useful thought even for veterans. Well done!
A lifesaver.......2003-05-30
I manage nearly 50 software engineers at a fortune 500 company. Once I got this book, I realized that our engineer contracts are extremely weak given the volatile nature of many software developers (something I've personally witnessed), and if anything ever went wrong under our existing terms, we'd be in a very litigious situation. Thanks to the information presented here, however, I've been able to outline a strategy for our legal department to consider for a revised draft that could potentially save our company millions of dollars and countless manhours of paperwork in averted lawsuits and other such nightmares. Take it from me-- most engineering managers and entrepreneurs are not as well versed in legal issues as they should be. This book was a huge eye-opener and I recommend it highly.
Finally, somone that knows something about law!.......2003-05-29
This is a great book for anyone that wants to know the actual details of media related law and intellectual property, but doesn't have the time to get a law degree. I own a small software and web company and we are constantly paying attorneys to review "potential" copyright, patent, and other infringements. I have wasted so much time paying for legal advice, but it seems like these experts never can give me a straight answer. I have been looking for a book that can be understood by a non-attorney, but that has explicit examples of copyright law, trademarks, what is legal, and what is not. After reading this book, I feel 100x more confident now, and I immediately no longer need legal advice in many areas, I KNOW the law in the areas, and can be confident that my decisions are reasonable. I highly recommend this book to any executive or business person that is in the intellectual property loop, but is sick of not understanding what is what.

Customer Reviews:
For those serious about producing.......2007-06-08
Good basic legal information oriented towards the independent feature film producer but useful for anyone who wants to produce film or other distributed video. Won't replace having an attorney but will allow you to do some things by yourself and understand what is going on when you need to hire one. Similar to "The Independent Film Producer's Survival Guide" but with enough distinct material (example contracts for instance) to be worth having both.
Excellent resource.......2007-05-13
Comprehensive and a terrific resource. The goal is not to use the book instead of legal advice, but it is a terrific starting point.
Irena Tully, Impulse Films & Prestige Entertainment.......2007-02-09
This is a useful and inspirational book that explains a variety of legal film production matters and provides drafts of contracts for basically every aspect of film & TV production. And it covers all major players in the colossal process of making a film, helping to make sure that whatever your role in the production is, you understand your rights.
Decent book - no CD.......2007-01-03
This book is a good collection of legal contracts for the industry, but it doesn't have a CD-ROM or associated website where you can download the contracts as a starting-point template.
I believe the author is gouging us by forcing us to buy the CD separately. Very cheesy business practice. I hope you have OCR software to scan these pages into your computer.
A fine and thorough book.......2001-07-10
Litwak provides about as much as a professional could share in this throrough outing. He also shares 'boilerplate' contracts for virtally all key players in a film production. Of course, direct experience is the best teacher, but EVERY neophyte in film or television must own this book, and its a handy reference for seasoned professionals and part-timers.
Also check out his companion book, "Dealmaking..." which has priceless cues on what gray areas to avoid in negotiating with lawyers and their clients.
Essential for producers, directors, writers and anyone hoping to get financed or paid or both!
