Guides to the evaluation of Permanent Impairment.......2007-06-02
This book is jam packed and jelly shut with powerful information for the sharp expert who simply needs to just fine tune his or her skills. This is also a must for every primary caregivers personal library.
better, but could still use improvement.......2007-03-04
Several chapters, such as the one on the spine, lower extremities, skin, and pulmonary system are, indeed, quite well-written and fairly easy to follow.
The chapter on upper extremities, however, is simply in deplorable shape.
Moreover, the AMA guides did not do a good job of explaining when it is appropriate to use a certain method and when it is not. in many cases, the evaluator is not sure which method to use, even after a careful reading of the guides.
The overarching philosophy of the Guides is not explained as well as it should be.
All in all, however, a vast improvement over the much more difficult to use fourth edition.
needless to say, a physician using this book needs both an instructor and an appropriate patient population to refine his/her skills as a disability evaluator.
Better than Ambiem and a shot .......2007-01-10
Absolutely the best bedtime reading to fall quickly asleep. Much more effective than 1-4th Editions. Richard S Glosser MD Orthopedic Surgeon.
AMA Guides.......2007-01-04
It's the standard. Can't get around it. Examples are very good. Read through the examples for a thorough understanding and you'll be fine.

I ordered these for independent adjusters who work for my firm, and they find them indispensable. Because I am not an adjuster, I am unable to evaluate them.

There is no easy way to preserve your parents assets...........2007-06-02
This is a really grim but realistic assessment of the major attack on the middle class that congress has waged.
We baby boomers have elderly parents going into nursing homes.
Since Medicaid is only for indigent people without more than $2000 total in assets, our parents do not qualify to have the government pay for their care in nursing homes. But with the yearly cost of nursing homes around $70,000 per year or more, our parents can't pay for it out of their assets. We are really stuck.
Each year congress clamps down harder on us, narrowing the ways that we can try to hang onto our parents life savings when they need to go into nursing homes. They will need to have some money in the bank to pay for all the things not provided for them, such as haircuts, private nurses, televisions, clothing, etc.
In trying to qualify for Medicaid, parents gift children their life savings but this causes a five year waiting period before they can then qualify for Medicaid.
There is the new Personal Services Contract which states that caretaker children of their parents are entitled to a fair compensation for taking care of aging parents. This does not mean the usual cooking and housekeeping, but actually performing nursing duties around the clock. A court has ruled that the child who does this is entitled to the going wage for this type of work. Therefore, before this work is done for the parent, a Personal Services Contract must be prepared by a lawyer who specializes in Medicaid planning. The drawback is that all the taxes must be paid on this just as if it were any other type of employee paycheck.
This book does a very good job of briefly describing various methods that might preserve an elderly person's assets from being siezed by the government to pay for the nursing home. It gives some critical details that can actually make or break the application for Medicaid, such as exactly when to apply, neither too early or too late.
It is horribly depressing to see an elderly parent's life savings be eaten up by nursing home costs. If the nursing home doesn't get it the governmet will. You may be able to preserve at least some of it though with the help of a good eldercare lawyer. Don't be unprepared though. Read this book first, and good luck!

The question of how to protect your family assets is timely. It is an important consideration faced by the majority of American citizens. As a result of longer life expectancy, rising medical costs, and complicated governmental programs, more and more people are forced to spend all their money before they ever qualify to take advantage of Medicaid benefits. Heiser's book is a godsend as it guides the reader through the complex issues relating to Medicaid benefits, qualifications, and application strategies.
This amazing guidebook will help you discover the secrets of protecting your family assets in ways that will not disqualify you from Medicaid benefits. The contents include a comprehensive working definition of Medicaid, what is provided, and how to apply for the program. Medical and income qualifications are covered in detail. Strategies for transferring assets, setting up trusts, and planning annuities are all addressed.
I personally found the Case Studies to be helpful. These examples gave several possible scenarios which offered me ideas for integrating these applications to planning an approach to finding solutions in my own life situation.
The appendix contains important information on a Durable Power of Attorney, as well as valuable suggestions on obtaining a qualified attorney. A glossary, important statistical tables, some applicable federal laws, a list of resources and agencies available, and Medicaid questionnaires, all make this a valuable resource and reference guide.
J. Gabriel Heiser, an attorney, with over 23-years experience in the field of elder law and estate planning is well-qualified to author this book.
This is an important guide for retirement planning and for anyone with a family member in, or approaching, a long-term-care situation. It can also become a valuable resource and reference guide for professional financial and estate planners, attorneys, for people in the medical profession, social workers, and ministers.
I found the book to be crucial, timely, and important. "How to Protect Your Family's Assets from Devastating Nursing Home Costs: Medicaid Secrets" is a book that should be read by every American tax payer as well as by every recipient and future recipient of Medicaid benefits.

Book Review
How to Protect Your Family's Assets from Devastating Nursing Home Costs: Medicaid Secrets
By Gabriel Heiser, Esq.
Medicaid is a vast federal bureaucratic healthcare system that operates on the federal, state and local levels. The federal government delegates considerable rule making authority and discretion to the individual states, which, in turn, delegate to individual counties their own regulation-making power. Added to this percolating brew is the reality that individual nursing homes make their own rules and policies for dealing with Medicaid recipients.
Thus, legal practitioners, government officials and inquiring citizens are confronted with a regulation-intensive field of law and public health so labyrinthine that even Daedalus and Icarus would have to put attorneys on retainer to help them navigate through it.
Gabriel Heiser is an attorney in Boulder, Colorado, specializing in Medicaid qualification matters as a sub-set of his practice in elder law. He has written How to Protect Your Family's Assets from Devastating Nursing Home Costs: Medicaid Secrets, a straight-forward concise volume that clarifies and simplifies the processes of analyzing Medicaid qualification and payment issues and crafting strategies for dealing with them in a cost-effective way in real-life situations.
The book has a Table of Contents that is logically organized and indicates that the major components of the topic are thoroughly addressed. The Index illustrates the excellent organization of the book and makes it easy to reference back to specific concepts within the text.
One aspect that I liked particularly was Heiser's detailed references in the text to material previously covered. Instead of writing something generic such as, `as stated earlier' or `as I previously covered,' Heiser gives specific page numbers and topic headings. The book is, thus, highly user friendly for the lay person as well as for the knowledgeable practitioner.
The book also provides Medicaid contacts for each state; a list of resources and citations to relevant federal statutes. I found both refreshing and admirable Heiser's direct forthright addressing of the ethical dimension of a lawyer giving advice intended to reduce the financial burden imposed on an individual or on a family when qualifying for and receiving Medicaid benefits.
Anticipating critics, Heiser gives examples where profligacy and irresponsible behavior have been financially rewarded and where thrift and self-sacrifice have been punished. He ends the topic with a trenchant quote from Justice Learned Hand: "Anyone may so arrange his affairs that his taxes shall be as low as possible; he is not bound to choose that pattern which will best pay the Treasury."
Heiser's book builds on the overall topic incrementally from basic concepts--what is Medicaid?--to rather sophisticated arcane aspects of Medicaid law. Heiser displays the enviable skill of breaking down into understandable segments esoteric concepts that do not trip easily off the tongue such as the Community Spouse Resource Allowance, irrevocable trusts, minimum monthly maintenance needs allowances and penalty dates.
Upon completing the book, the reader will not be sufficiently trained to walk into federal court and litigate a case, of course, but the reader will have a comprehensive grasp of the issues to guide future financial decisions and to ask more probing questions of legal counsel. As a disclaimer, Heiser emphasizes that obtaining the advice of an experienced elder law attorney in the client's home state is essential to successful Medicaid planning.
I end this review with two judgments. First, the book is not about Medicaid `secrets.' Rather, it is about the analysis and deductions made and implications offered by a skilled lawyer trying to make accessible the rules and laws imposed on a massive bureaucracy. If in this day and age the effort to describe the law to average citizens constitutes secrets, then there is much to lament. Second, the book does not show how to protect all assets from nursing home costs. It shows how to protect some assets and how to distribute some of those assets to family and recipients other than to the layers of government.
The book is easy to read. It is free of mind-numbing jargon and arrogant intellectual self-indulgence. It is meant to be a foundational primer to help people keep some of their assets should life's tempests require access to Medicaid nursing home benefits. It successfully achieves that goal.

How to Protect Your Family's Assets from Devastating Nursing Home Costs: Medicaid Secrets.......2007-03-06
I found this book to be well written, easy to follow, and well organized. I think it would make a great addition for the estate planning attorney's bookshelf as well as any family about to enter the confusing world of Medicaid with their loved one. It gives an overall view of what you can and cannot do with Medicaid as well as pointing out the need to navigate with a professional to fully understand the rules in each state.
Refreshingly informative review of elder law and Medicaid .......2007-03-02
I'm an attorney who never learned about Medicaid in law school. When my mother became elderly, I consulted an attorney who specialized in elder law, but I couldn't fully understand the explanation given about Medicaid, estate planning and nursing home care. Now, having read attorney Heiser's book, I realize that it wasn't me! This is a complex subject, which Mr. Heiser has finally explained in a logical, comprehensive, and easy-to-understand way. This refreshingly informative book puts all the parts of the Medicaid puzzle together in one resource that focuses on obtaining quality long-term care while preserving one's personal assets. Using a practical approach, Mr. Heiser explains the "ins and outs" of Medicaid qualification as a teacher would, offering helpful examples and case studies. I have recommended this book both to my attorney and non-attorney friends who have parents or loved ones, or who are themselves facing nursing home stays.

Good solid book for both lawyers and educators........2000-06-01
This book is a must-have for educators. Since the push for inclusion means many students with disabilities are entering regular schools and classrooms with their peers, it is of great worth that the regular teacher as well as the special education teachers know the background of the laws that pertain to these students with diverse needs. It would be beneficial to both students, teachers, and parents to know and understand how the laws are applied in court, what an IEP is, what is expected of the teachers, and what can be expected of the students. I have the other major law books on disability laws, but this one is more geared toward other participants in the process besides lawyers. It is very readable and very understandable without having to go to law school to get a background in law first. I suggest this or rather recommend this to my friends and students who are interested in working with those with disabilities in regular school settings. Way overpriced.......2006-05-21
First off, this book is waayyyy overpriced. There are other good books on the market at half the cost. And there are other books that are better written, too. I was surprised at the sloppy writing of this new edition. If you are intent on buying this book, find a used copy of the last edition, which is better, or choose one of the better books out there. Don't go by ratings alone. Check out the book in your local bookstore first, just to be sure you find one that meets your needs. The information is this book can be found on the Internet on different sites, so there is no needed to shell out hard-earned dollars for this one. Find something else and you won't be sorry.
From a mom with a son with Tourette Syndrome.......2003-01-20
Whether you are new to the world of "special ed" or you are a seasoned veteran, attorney, Lawrence M. Siegel's book will guide you through the advocacy maze with ease. It is a valuable resource of information, including, but not limited to: an overview of special ed and the IEP process; sample IEP forms and letters; organization and planning tips; a listing of support groups, advocacy organizations and federal and state departments of education. Laws and procedures change frequently, and regulations can be different from state to state, so new editions are printed periodically. You can even take advantage of an "update service" that offers a 35% discount on any future purchases.
This is quite possibly the best resource available for assistance in navigating the path of the IEP process, so that you feel more in control of the situation. Although no published material can completely replace a knowledgeable expert or lawyer, I am now confident that I have sufficient knowledge of the IEP process to be able to be an effective advocate for my child.
Good overview, but doesn't replace having an advocate/lawyer.......2002-06-12
This guide provides a good overview of the special education and IEP process, as well as some sample forms and letters. It also usefully collects the relevant federal statutes and regulations. But I found the descriptions of the process to be quite different from what happens here in D.C., so that ultimately its utility was somewhat limited. There is, perhaps, no solution to this -- the book can't be written for every school district in the country. So while the book is useful, in many areas you will be well served to hire a special ed consultant and/or attorney.
EXCELLENT RESOURCE!!.......2002-05-13
THIS IS AN EXCELLENT RESOUCE BOOK FOR THE PERSON WHO IS A FIRST TIMER FOR IEP MEETINGS AS WELL AS FOR THE SEASONES VETERANS. I REVIEW IT FOR EACH IEP MEETING. IT IS ONE OF THOSE MUST HAVE BOOKS.
Wonderfurl Resource.......2002-03-15
This book has been a wonderful resource as we have journied through the special education system. I bought this book because we were struggling to get our school system to recognize the many difficulties of having a child with bipolar disorder and severe learning difficulties. I really like the forms and easy to use charts.

Good reference for special needs trusts.......2007-05-07
Goes over administering SNTs in detail. Good explanation of the mechanisms related to SSI, SSDI, and Medicaid, and how they interact with the SNT. Oriented to Massachusetts law, where the authors are, although should be similar in other states since law is federal with state "twists". Has a list of "do nots" and "watch out for" items that is useful, although the list is spread out through the book, would be useful to have an appendix summarizing them. Has a chapter on web site references to go to for more info. Finally, the tax section I thought was a bit vague, as it didn't distinguish between distributions that are return of corpus vs. return of income, and didn't make some other things clear. Overall, however, a good reference.
very helpful and practical advice.......2005-04-02
This Manual has been an invaluable resource for our office. Our office is the Trustee for Special Needs Trusts, and having such practical advice in one book has been extremely helpful for our staff. It is readable, cogent, and well organized. It is a useful tool for attorneys and non-attorneys who are trying to better understand the many issues involved with coordinating public benefits and special needs trusts. The information that it provides on Trust Administration is very useful information for anyone who is a Trustee of a Special Needs Trust. Our office is purchasing multiple copies because it is sucha a helpful resource.
Great Basic Guide for Trustees of Special Needs Trusts.......2004-12-28
Coordination of public benefits and special needs trusts are a complicated matter. I like this affordable guide because it doesn't confuse by trying to give the reader a law degree like some books. It gives straight forward, practical answers that go a long way to explaining day to day administration, particularly for the family member or professional fiduciary that doesn't have a lot of prior experience with government programs and special needs trusts. While it uses Massachusetts examples for some of the programs that could become dated over time, it makes an effort to be generic and timeless, and 95% of the content is good anywhere at anytime. I draft special needs trusts naming Trustees with a wide range of experience, from zero to full time, and I will be sending a copy of this guide to all of them.

Book Description
Are IQ tests racially and culturally biased? That was the controversial question in two landmark lawsuits: the California case of Larry P. v. Riles (1979) and the Chicago case of PASE v. Hannon (1980). Litigating Intelligence is a detailed analysis and comparison of these complex cases--the background, evidence, testimony, arguments, and surprising outcomes. It is also an important case study of the role of social science testimony in the courtroom and the role of the courts in setting social policy.

This book is an excellent resource.
social security disability and the legal professional.......2002-11-28
Having represented many people in their appeal process for disability benefits for the past 13 years, I have found that understanding the Administration's maze of regulations is full time effort. After a careful review of this book, it is my opinion that it will provide invaluable information for a newcomer to Social Security Representation as well as others with more experience. Wolf and Prozcek did a very good job and find myself referring to this book several times each week,to make certain that I did not leave "a stone un-turned'. It is my understanding that Wolfe is an Administrative Law Judge(ALJ) and Mrs. Proszek was a senior staff attorney with the Office of Hearings and Appeals-SSA, which adds to the credibility of this book. They write the decisions. Therefore, they covered in the book exactly what they would expect of a representative to provide for there client during the appeal process and at a hearing. It is a prudent practice to fully develop your case before you step in the hearing room, follow the steps in the book and you will make a better impression on the ALJ and provide your best effort for your client. I wish that I had a copy of this book 13 years ago!

Book Description
"Claim denied!" All too often millions of veterans have received this response to their legitimate claims for federal benefits. In most cases, writes veterans' advocate John D. Roche, the claimant didn't understand the procedures needed to meet the myriad requirements of the Department of Veterans Affairs. With the appeals process requiring years to resolve disputes, deserving veterans and their dependents are left confused and frustrated by the agency and a system that was created to serve them. The answer is to submit a well-grounded claim initially, which The Veteran's Survival Guide, now in a revised, second edition, analyzes in detail. This unique book, written in an accessible self-help style, will be required reading for any veteran or veteran's dependent who wishes to obtain his or her well-earned benefits and for those officials of veterans' service organizations who assist veterans with their claims.

Very Helpful.......2007-06-09
This Veteran's Manual on "How to File a VA Claim" is helpful when veterans are preparing their VA claim. It covers all the necessary requirement's. If a veteran follows all the suggestions in this manual he/she will have NO problems having thier VA claims' approved.
Good Luck,
John
A necessity for anyone dealing with the VA claims system.......2007-05-21
This is a must have for anyone filing for VA service connected benefits. If you are reading this you probably already know how frustrating it can be dealing with this system. There are rules, laws, standards, etc...that the author clearly explains. He also makes it clear that the VA is NOT going to help you with your claim, regardless of what they say they will do. You must collect certain information supporting your claim and follow a particular process to gain the best results. This book is by the far the best tool for anyone facing this system. Empower yourself with knowledge, don't just go along with what others tell you. Best of luck!
Requesting help for disabilities.......2007-03-09
I have read the book and very impressed. I have ordered 3 copies, 1 for each Service Officer in Chapter #14 Disabled American Veterans. I recommend this book but do not approve of Veterans trying to get information or service connected Disabilities by themselves. Contact a Chapter Service Officer. Since getting the boks the Srvice Officers have been submitting request and getting excellent results for veterans. The book has been very helpful and will be continued to be used. Everything I have read is true.
Remember the Veterans of this great Country. The Disabled, Physically or Mentally, that need help.

The Best Advice For Disabled Vets Ever.......2007-01-27
After 13 years of frustration and aggravation with the VA,I found this book. It was a stroke of luck I have shared with a half a dozen other vets. Those who have followed the advice in the Survival Guide have prevailed with their claim. Like me, they too were able to get through all the roadblocks and detours and submit a claim which the VA accepted. The Survival Guide would be more than worth it if the price was $100.00
